The welfare acts work in conjunction with the health and safety acts for instance if you have someone that’s been assessed to need the hoist but they have no desire to be in it perhaps because they find it degrading then providing they have their mental capacity it is their choice and needs to be an absolute last option.

If someone hasn’t got their mental capacity then you have a duty of care then you need to go down the mental capacity assessment.

Many other acts exist such as disability and discrimination act, the social care act etc.
